Tusayan incorporation election is cancelled

FLAGSTAFF, Ariz. - Voters living within the boundaries of the proposed "town" of Tusayan will be notified in writing by the County Elections Office that the Nov. 3 election to consider incorporation has been cancelled.

The cancellation was the result of a lawsuit and subsequent judgment issued by Judge Kreamer of Maricopa County Superior Court, ordering the Coconino County Board of Supervisors to cancel the election. The Board adopted Resolution 2009-40, canceling the Nov. 3 election at their regular Oct. 6 meeting.

The process began when the group "United for Tusayan" filed petitions with the Elections Office to incorporate Tusayan. The determination was made that the group had met the minimum number of signatures needed to put the question before voters and, on July 14, the board called for an election.

On July 17, a civil complaint was filed. The complaint challenged the validity of the planned election and sought an injunction against conducting the election. Subsequently, both parties to the suit agreed that the election should not be held on this date, resulting in Judge Kreamer's judgment.

Prior to cancellation, the Elections Office sent voters a postcard notifying them of the upcoming election. It included information about the all "vote by mail" election and the date ballots would be mailed out.

Sending letters to eligible voters will help ensure that all voters are aware of the cancellation.
